Terms of Service for Pencilius

Welcome to Pencilius! These Terms of Service ("Terms") govern your use of our website, services, and features (the "Service"). By creating an account or using Pencilius, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Pencilius. By using our Service, you confirm that you meet this requirement.

2. Your Account

  • You are responsible for keeping your username and password secure.
  • You are responsible for all activity that happens under your account.
  • If you believe your account has been compromised, please notify us immediately.

3. Payments

  • Payments are handled securely by Stripe.
  • All charges are non-refundable unless otherwise required by law.
  • You agree to provide accurate and complete payment information.

4. Acceptable Use

You agree not to use Pencilius to:

  • Break the law or infringe on others' rights.
  • Interfere with or disrupt our systems.
  • Upload or share harmful, offensive, or illegal content.

5. Imports & Third-Party Services

  • Our Imports feature uses Google Cloud AI to process data you submit.
  • By using Imports, you agree that your data will be sent to Google Cloud for processing.
  • According to Google Cloud's paid services policy, your data is not used to train Google's models.

6. Intellectual Property

  • Pencilius and all related trademarks, logos, and content are owned by us or our licensors.
  • You retain ownership of any content you upload, but grant us a license to use it solely as needed to provide the Service.

7. Termination

We may suspend or terminate your account if you violate these Terms. You can stop using Pencilius at any time by closing your account.

8. Demo Mode

  • Pencilius may provide a demo mode without authentication for evaluation only.
  • Demo content is processed transiently and not retained unless you create an account and choose to save it.
  • Certain features (exports, integrations, webhooks) may be disabled or limited.
  • We may throttle or terminate demo access at any time to prevent abuse.

9. Disclaimer of Warranties

Pencilius is provided "as is" and "as available." We make no guarantees about uptime, reliability, or fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent allowed by law, Pencilius is not liable for any indirect, incidental, or consequential damages resulting from your use of the Service.

11. Changes to These Terms

We may update these Terms occasionally. If we make significant changes, we'll notify you by posting the new Terms here with the updated effective date.
